Source text - English 41. As to the extent of the use to which the earlier trade mark has been put, account must be taken, in particular, of the commercial volume of the overall use, as well as of the length of the period during which the mark was used and the frequency of use.
42. To examine, in a particular case, whether an earlier trade mark has been put to genuine use, an overall assessment must be carried out, which takes into account all the relevant factors of the particular case. That assessment entails a degree of interdependence between the factors taken into account. Thus, the fact that commercial volume achieved under the mark was not high may be offset by the fact that use of the mark was extensive or very regular, and vice versa. In addition, the turnover and the volume of sales of the product under the earlier trade mark cannot be assessed in absolute terms but must be looked at in relation to other relevant factors, such as the volume of business, production or marketing capacity or the degree of diversification of the undertaking using the trade mark and the characteristics of the products or services on the relevant market. As a result, the Court has stated that use of the earlier mark need not always be quantitatively significant in order to be deemed genuine (Ansul, paragraph 39).
Translation - Hungarian 41. Ami a korábbi védjegy használatának jelentőségét illeti, figyelembe kell venni különösen, egyrészt a felhasználások kereskedelmi mértékét, másrészt a védjegy használatának időtartamát és gyakoriságát.
42. Egy korábbi védjegy tényleges használatának egy konkrét esetben történő vizsgálata során olyan teljes körű mérlegelésre van szükség, amely az adott ügy minden jelentős tényezőjét figyelembe veszi. Ezen mérlegelés a figyelembe vett tényezők között kölcsönös függőséget eredményez. Ily módon a szóban forgó védjeggyel ellátott áruk csekély mértékű értékesítését ellensúlyozhatja az áruk koncentrált, illetve rendszeres értékesítése azon időszak alatt, amely alatt a védjegy használatára sor került és vice versa. Ezen felül a megvalósított bevételt és a korábbi védjeggyel ellátott áruk értékesítésének mértékét nem lehet abszolút értelemben, hanem olyan egyéb releváns tényezők figyelembe vételével kell mérlegelni, mint a kereskedelmi tevékenység mértéke, a védjegyet használó vállalkozás gyártási és forgalmazási kapacitása, a védjegyet használó vállalkozás bővülési mértéke, továbbá a releváns piacon az áruk és szolgáltatások jellegzetességei. Ezért a Bíróság kimondta, hogy a mennyiségileg jelentős használat nem szükségszerű feltétele annak, hogy a korábbi védjegy használata ténylegesnek minősüljön (a fent hivatkozott Ansul ítélet, 39. pont).

Source text - English 8. The first category is what the Commissioners term ‘acquisition fraud’. A VAT-registered trader in the United Kingdom acquires goods from another Member State and sells them in the United Kingdom. The sale is exempt from VAT in the Member State of dispatch under Article 28c(A)(a) of the Sixth Directive and the purchaser is required to account for tax in the United Kingdom pursuant to Article 28a(1)(a) of the Sixth Directive. The trader sells the goods at a price including VAT, but fails to pay over to the Commissioners the VAT received on the onward supply, and disappears.
9. The second category has become known as ‘carousel fraud’. This involves a more complicated scheme, which in essence works as follows. A company (‘B’) established in the United Kingdom, buys goods from a company (‘A’) in another Member State. No VAT is due from A in respect of the acquisition, but B is required to account for VAT in respect of its onward sales in the United Kingdom. B sells the goods, usually at a discount, to a third company (‘C’) also established in the United Kingdom, but fails to account for VAT. C is called a ‘buffer company’. It sells the goods to another company in the United Kingdom at a small profit, accounting for VAT on the sale, but reclaiming input VAT. There may be a series of further sales, but eventually the goods reach a company which sells them to a VAT registered trader in another Member State. This sale is exempt from VAT, but the seller is entitled to recover input tax and accordingly seeks to recover from the Commissioners the VAT which it paid on its purchase of the goods from the last buffer company. If such repayment is made, the Commissioners pay to this company the VAT charged on the sale by the last buffer company and yet do not receive the amount charged as VAT by B. The hallmark of a true carousel fraud is that the goods are ultimately sold back to the original seller, company A. The cycle can then start again. On each circuit of the carousel the amount paid as VAT to B is extracted from the public revenue. The carousel may revolve like this on a daily basis. B may use a ‘hijacked’ VAT number of an unsuspecting third party or it may register itself for VAT and simply disappear before the tax authorities take action. The goods involved are usually of small size and high value. It is stated in the order for reference that this type of fraud costs the United Kingdom public revenue in excess of £1.5 billion per annum.

Az Egyesült Királyságban a HÉA-nyilvántartásban szereplő kereskedő egy másik tagállamból terméket hoz be és azt az Egyesült Királyságban értékesíti. A származási tagállamban az adásvétel adómentes a hatodik irányelv 28 c. cikk A. részének a) pontja alapján, míg a vevő adókö-teles az Egyesült Királyságban a hatodik irányelv 28 a. cikk (1) bekezdése a) pontja alap-ján. A kereskedő olyan áron értékesíti a terméket, amely tartalmazza a hozzáadottérték-adót, de nem fizeti meg a Commissioners részére a következő termékértékesítést terhelő HÉÁ-t, majd eltűnik.
9. A második kategória a „körhinta” jellegű adókijátszás néven ismert. Itt egy bonyo-lultabb rendszerről van szó, amely lényegében a következőképpen működik. Az Egyesült Királyságban letelepedett („B”) társaság terméket vásárol egy másik tagállamban („A”) társaságtól. A beszerzéssel kapcsolatban A nem fizet HÉÁ-t, azonban B elszámolja a HÉÁ-t a továbbértékesítés után az Egyesült Királyságban. A C elnevezése a „közbenső társa-ság”. E terméket kis nyereséggel értékesíti valamely másik társaság részére az Egyesült Királyságban, kiszámlázza a HÉA-t az értékesítés után, ugyanakkor levonja a HÉA-t. Újabb adásvételekre kerülhet sor, és végül a termék olyan vállalkozáshoz kerül, amely azt valamely más tagállam HÉA nyilvántartásában szereplő másik kereskedő részére értékesí-ti. Ezen utolsó adásvétel adómentes, de az eladó jogosult a megfizetett adót visszaigényel-ni és ennek megfelelően visszaigényelni a HÉÁ-t a Commissioners-től, amelyet megfize-tett a közbenső társaság részére értékesített termék után. Amennyiben ilyen visszafizetés történik a Commissioners megfizeti a társaságnak a közbenső társaság által az értékesítés után felszámított HÉÁ-t, nem kapja azonban meg a B által felszámított HÉA összegét. Egy valódi „körhinta” jellegű adókijátszás ismertetőjegye, hogy végül a terméket az ere-deti eladónak, A társaságnak értékesítik. És a körforgás újra kezdődhet. A körhinta min-den egyes fordulatakor a B részére kifizetett összeg adóbevétel-kiesést jelent. A körhinta így körbe foroghat nap mint nap. B jogtalanul eltulajdonított HÉA számot is felhasználhat, vagy HÉA-alanyként nyilvántartásba vetetheti magát, és még mielőtt az adóhatóság köz-belépne, egyszerűen eltűnhet. Az érintett áruk rendszerint kis méretűek, azonban nagy értékkel bírnak. Az előzetes döntéshozatalra utaló határozatban megállapításra kerül, hogy a csalás e fajtája az Egyesült Királyságban több mint 1,5 milliárd adóbevétel-kiesést okoz.

Source text - English 15. The Commission makes clear at the outset that it does not object to visa requirements and prior controls to the extent that these are justified on grounds of public policy, public security or public health. Neither does it object to controls aimed at verifying whether the so-called Vander Elst criteria have been fulfilled. The only point of contention is that according to German practice this verification must take place prior to the deployment of the workers concerned on German territory. Where an authorisation is granted in the form of an ‘Arbeitsvisum’ (work visa), it is clear that without this document a worker will not be able to be deployed on German territory in order to perform the services to be provided by his employer. It, therefore, constitutes a restriction of the freedom to provide services. The Commission observes that the procedure goes beyond checking what is necessary for reasons of public security. Moreover, as it does not apply to all those providing services in Germany, it does not fulfil the conditions for being justified on imperative requirements relating to the public interest. In addition, the Commission considers that less restrictive measures, such as ex post checks, are envisagable in order to attain the objective of ensuring that the workers return to the Member State of origin. Such a check could be performed at the moment a person complies with the obligation to register in taking up residence in Germany.
16. The German Government points out that the current practice of granting visas does not leave any discretion to the diplomatic representations and that authorisations to stay are granted automatically within a period of seven days. It therefore doubts whether this practice amounts to a significant restriction of the freedom to provide services. The so called Vander Elst visas are only required in a limited number of cases, in particular where third country nationals are not eligible to travel freely under the conditions of the Convention implementing the Schengen Agreement and where visas are required under Regulation No 539/2001. A Bizottság bevezetésként egyértelművé teszi, hogy nem vitatja a vízum követelményeket és a megelőző ellenőrzést, amennyiben azok a közrend, közbiztonság vagy köz-egészségügyi okok alapján indokolt. Nem vitatja azokat az ellenőrzéseket sem, amelyek célja annak igazolása, hogy az úgynevezett Vander Elst feltételeket teljesítik. Egyedül az vitatható, hogy a német gyakorlat alapján az ellenőrzésnek meg kell előznie az érintett munkavállaló német területre történő kiküldetését. Amennyiben engedélyt bocsátanak ki egy „Arbeitsvisum” (munkavállalási engedély) formájában, egyértelmű, hogy enélkül a dokumentum nélkül a munkavállaló nem küldhető ki német területre azért, hogy a munkaadója által nyújtott szolgáltatást teljesítse. Ez a szolgáltatásnyújtás szabadságának korláto-zását jelenti. A Bizottság megjegyzi, hogy az ellenőrző eljárás túllépi a közbiztonsághoz szükséges mértéket. És mivel nem mindenkire alkalmazandó, aki Németországban szolgáltatást nyújt, ezért nem felel meg azoknak a feltételeknek, amelyeket a közérdeken alapuló kényszerítő indokok igazolnak. Továbbá, a Bizottság álláspontja az, hogy vannak kevésbé korlátozó jellegű intézkedések, mint az utólagos ellenőrzések, amelyek biztosítják annak a célnak az elérését, hogy a munkavállaló visszatér a származás szerinti tagállamba. Ilyen ellenőrzés akkor hajtható végre, amikor a személy teljesíti bejelentési kötelezettségét a Németországban történő tartózkodáshoz.
16. A német kormány rámutat, hogy a vízum kiadásának jelenlegi gyakorlata nem függ a diplomáciai képviseletek diszkrecionális jogkörétől, és az engedélyeket automatikusan hét napos időtartamon belül kiadják. Ezért vitatja, hogy a gyakorlat a szolgáltatások szabad nyújtásának jelentős korlátozásához vezet. Az úgynevezett Vander Els vízumok csak kor-látozott számú ügyben kötelezőek, különösen akkor, amikor a harmadik állam állampolgárságával rendelkező munkavállalók a Schengeni Megállapodás végrehajtásáról szóló egyezmény feltételei alapján nem jogosultak a szabad utazás jogára, és amikor a 539/2001 rendelet vízumkötelezettséget ír elő.

A vám- és statisztikai nómenklatúráról, valamint a Közös Vámtarifáról szóló, 1987. július 23-i 2658/87/EGK tanácsi rendelet I. mellékletének nyomán létrejött a nemzetközi harmonizált áruleíró és kódrendszeren (a továbbiakban: HR) alapuló „Kombinált Nómenklatúra” (a továbbiakban: KN) nevet viselő árunómenklatúra.
