5.3 Unless otherwise stated in a Service Schedule any Committed Minutes shall represent a mix of traffic that is consistent with and representative of the Customer’s total mix of traffic to the relevant destinations and a Party shall not groom traffic based on any element, such as ported numbers, the geographic area of traffic termination, the provider of local network, the type of service or the time of the day. If a Party discriminates on any such basis in the allocation of its traffic, the other Party may terminate the affected Service Schedule by giving seven (7) days’ written notice; provided, however, that if such discrimination is corrected prior to the end of the notice period, to the reasonable satisfaction of the Supplier, the relevant Service Schedule shall not terminate and all obligations shall continue as if the termination notice had not been sent.
