WASHINGTON, May 2, 2003 — At the Federal Trade Commission Spam Forum in Washington D.C. today, Paul F. “Pete” Wellborn, outside counsel for EarthLink (NASDAQ: ELNK) urged all ISPs to adopt a universal relief clause that EarthLink uses in its legal proceedings against spammers. The following statement can be attributed to Wellborn:

“EarthLink pioneered a method of resolving spam-related cases that protects all Internet users, not just EarthLink and its customers, from spammers. By adopting a universal relief clause when seeking an injunction against a spammer, a defendant spammer is prohibited from operating on all networks, not just the plaintiff ISP’s network.

“EarthLink urges all ISPs – big and small – to adopt a similar legal strategy so that the integrity of the Internet experience can be preserved for all users. EarthLink will be pleased to share its legal brief that discusses the necessity and legal authority for asking for universal relief, even in cases that involve a single ISP. The application of universal relief is important because it prevents spammers from taking the path of least resistance by simply moving on to other ISP’s networks.”

Civil Procedure Code, Order 20 Rules 9 to 19 - Decree - Relief clause in judgments and decree must be clear enough so that no court is required to interpret it again - It is the duty of the trial Court as also the appellate court while reversing the judgments and decrees of the trial Court to draw a decree clearly indicating the relief granted - The practice of stating the \"suit is decreed as prayed for or the appeal is allowed\" is not in accordance with the provisions of CPC - There might be various reliefs claimed by the plaintiff but all not granted.
